A UCC-1 lien, formally called a UCC-1 financing statement, is a legal filing that a lender makes to establish a security interest in a borrower's personal property used as collateral for a loan. In the residential solar context, a UCC-1 is filed by the solar lender when a homeowner installs solar through a traditional solar loan.
The lien attaches to the solar equipment. The solar equipment is attached to the home. The lien, in practice, attaches to the property.
FHA guidelines require a clean title. A property with an outstanding UCC-1 lien attached to a solar system does not have a clean title in the eyes of an FHA lender.
This creates a problem at closing.
The seller must pay off the solar loan before the FHA buyer can close. If the seller cannot or will not pay it off, the transaction cannot proceed. What looked like a straightforward purchase becomes a negotiation over a lien the buyer never expected to encounter.
